Butser Plus Terms of Use
This is an agreement between ‘Butser Plus’ which is a trading name of Butser Education CIC and you, the subscriber.
- Acceptance
By creating an account, viewing videos, making a purchase, or otherwise visiting or using our Services, you accept this Agreement and consent to contract with us electronically.
If you are an entity other than a natural person, the person who registers the account or otherwise uses our Services must have the authority to bind the entity. In this context, “you” means both the entity and each person who is authorised to access the account.
We may update this Agreement by posting a revised version on our website. By continuing to use our Services, you accept any revised Agreement.
This Agreement includes our Privacy Policy. Please review our Privacy Policy to learn about the information we collect from you, how we use it, and with whom we share it.
- Accounts
Registration: You will create an account to use Butser Plus. To do so, you must provide an email address. By creating an account, you agree to receive notices from Butser Plus at this email address.
Age Requirements: You must be at least 18 years old or the applicable age of majority in your jurisdiction, whichever is greater, to create an account or otherwise use our Services. Individuals under the applicable age may use our Services only through a parent or legal guardian’s account and with their involvement. Please have that person read this Agreement with you and consent to it before proceeding.
Parents and Guardians: By granting your child permission to use the Services through your account, you agree and understand that you are responsible for monitoring and supervising your child’s usage. If you believe your child is using your account and does not have your permission, please contact us immediately so that we can disable access.
Account Security: You are responsible for all activity that occurs under your account, including unauthorised activity. You must safeguard the confidentiality of your account credentials. If you are using a computer that others have access to, you must log out of your account after each session. If you become aware of unauthorised access to your account, you must change your password and notify us immediately.
- Copyright Licence Grant and Restrictions.
Licence: Subject to the terms and conditions in this agreement, Butser Plus grants you a limited, personal use, non-transferable, non-assignable, revocable, non-exclusive licence to view our content. As a condition of this you agree not to:
- copy the Butser Plus content
- rebroadcast, or transmit the Butser Plus content available
- use the Butser Plus content in any unlawful manner
- allow third parties to violate the above restrictions
- Subscription Fees
Fees: You must pay all fees during your subscription period and any renewal periods. Our fees are either a fixed monthly or annual fee. You can view your receipts and invoices by logging into the Orders menu item in your account.
Automatic Renewal: Your subscription to Butser Plus includes enrolment into an ongoing/recurring payment plan. Your subscription will automatically renew at the end of the disclosed billing period, unless cancelled in accordance with the instructions for cancellation below.
How to Decline Renewal: Subscribers may opt out of automatic renewal at any time by logging into the subscriptions menu item in your account, or using the link here and selecting ‘turn off auto-renew’. There is no fixed contract period and you are able to pause or cancel your donation at any point in the billing cycle. Your access to Butser Plus will remain until the end of your billing period.
Internet/Mobile fees: You are responsible for all third-party internet access charges in connection with your use of the Butser Plus service. If you access the Butser Plus services through a mobile network, your network or roaming provider’s messaging, data and other rates and fees will apply.
Resale: You may not sell, resell, rent, lease, or distribute access to Butser Plus or any other aspect of our Services to any third party unless authorised by us in writing.
Promotional Offers: We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by Butser Plus at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible.
- Term and Termination
This Agreement begins when you first use our Services and continues so long as you use our Service or have an account with us, whichever is longer. Paid accounts will continue for the subscription period and will renew in accordance with Section 4 above.
If you breach this Agreement, Butser Plus may, at its option: (a) terminate this Agreement immediately, with or without advance written notice; (b) suspend, delete, or limit access to your account or any content within it; and (c) to the extent permitted by applicable law, retain any amounts payable to you (which you forfeit). If we delete your account for breach, you may not re-register.
Upon termination of your account, (whether by us or as a result of you cancelling your subscription) you will lose the right to access the Butser Plus content.
- Disclaimers
Butser Plus makes no representations or warranties:
- That our Services, or any part thereof, will be available or permitted in your jurisdiction, uninterrupted or error-free, completely secure, or accessible from all devices or browsers;
- That we will host, make available, or remove any specific piece of content;
- That our Services will meet any business or professional needs;
- That we will continue to support any particular feature or maintain backwards compatibility with any third-party software or device
- General Provisions
Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of the United Kingdom.
Reservation of Rights, Severability: Butser Plus reserves all rights not expressly granted herein. No failure or delay by Butser Plus in exercising any right will waive any further exercise of that right. If any term of this Agreement is found invalid or unenforceable by a court of competent jurisdiction, that term will be limited or severed.
Force Majeure: Butser Plus will not be liable for any delay or failure caused by (a) acts of God/natural disasters (including hurricanes and earthquakes); (b) disease, epidemic, or pandemic; (c) terrorist attack, civil war, civil commotion or riots, armed conflict, sanctions or embargoes; (d) nuclear, chemical, or biological contamination; (e) collapse of buildings, fire, explosion, or accident; (f) labour or trade strikes; (g) interruption, loss, or malfunction of a utility, transportation, or telecommunications service; (h) any order by a government or public authority, including a quarantine, travel restriction, or other prohibition; or (i) any other circumstance not within our reasonable control, whether or not foreseeable (each a “force majeure event”). In the event of a force majeure event, Butser Plus shall be relieved from full performance of the contractual obligation until the event passes or no longer prevents performance.
